The Export Controls Director acts as the Empowered Official for Duke University. The Director has primary responsibility for the implementation of export control policies and procedures throughout the University, rendering training and advice to faculty and staff in all export related matters. In addition the Export Controls Director will be responsible for training and advising members of the university community in regard to travel to embargoed and sanctioned countries.
Implement training about export controls and travel to embargoed and sanctioned countries through workshops, a website, and other tools as appropriate.
Work with the Vice Provost for Research and the Chief Compliance Officer for the School of Medicine on institutional policy requirements regarding export controls and travel to embargoed and sanctioned countries.
Ensure University compliance with regulations by implementing and administering procedures for exports and travel such as:
Establishing Project Technology Control Plans Determining equipment classifications Determining licensing exceptions or requirements Screening end users, end use and countries for exported technology Screening subcontractors, surplus equipment purchasers and visitors to controlled facilities Determining travel requirements for embargoed and sanctioned countries Establishing procedures for documenting and monitoring on going projects as required by the regulations
Drafting and maintaining a manual of standard operating procedures to ensure consistency and compliance for all offices involved in exports and travel matters.
Draft and submit license applications and institutional registrations when necessary.
Act as liaison and coordinator for export related and travel matters between the various research and regulatory offices within the University.
Act as University liaison with Departments of Commerce, State and Treasury or any other federal agency in regard to export related matters and travel to embargoed and sanctioned countries.
Education/Training: | Work requires a Bachelor's degree in business, science, or related field. J.D. or related Master's degree preferred. |
Experience: | Work requires 7 years in legal, regulatory compliance, clinical research, or grants administration in a large complex organization such as a large university, hospital or healthcare organization with at least 3 years of experience in the area of export controls. A master's degree in Business Administration, science or a related field may be substituted for experience on a 1:1 basis. OR AN EQUIVALENT COMBINATION OF RELEVANT EDUCATION AND/OR EXPERIENCE. |
Skills: | An individual in this position must have a sound knowledge of laws and regulations such as the EAR, ITAR, OFAC, and Patriot Act to enable them to work with legal counsel and federal agencies regarding export, security, and travel related matters. Additionally, this person must have sufficient understanding of technology and the CCL and USML to work with investigators and technicians in making accurate technology classifications and licensing determinations. Evidence of excellent written and verbal communication skills required. |
