Occupational Summary
The Director of Equal Opportunity and Compliance/Deputy Title VI and IX Corodinator reports to the Associate Vice President for Institutional Equity, Equal Opportunity and Compliance/Title IX Coordinator. This position operates as the lead investigator providing support for the investigation team that is responsible for responding to complaints from Duke faculty, staff and students of all protected status-based discrimination and harassment and concerns related to the Consensual Relationship Policy. This position supports the AVP to make strategic decisions about investigations and oversight of the University's compliance with relevant laws, rules, policies and procedures.
In addition this position has responsibility for overseeing university compliance with Title VI of the Civil Rights Act of 1964 and Title IX of the Education Amendments of 1972. In this role the Director works closely with the Office of the Dean of Students on the intake of new matters, the provision of supportive measures and the adjudication of complaints. The Director will also have a principle role in the review and revision of policy and procedures implementing Title VI, Title VII and Title IX and its corresponding regulations.
Work Performed
Monitor developments in law, policy, and practice related to Title VI, Title VII, Title IX and other relevant state and federal laws and advise on necessary changes to policy and procedures.
Support the AVP to ensure that university policies, procedures, and practices are in compliance with the most recent regulations and guidance from appropriate government agencies and that they align with relevant federal laws and regulations.
Provide oversight to OIE compliance investigators with their case management, including applying the applicable policy and or regulation, reviewing and editing relevant documents, supporting adherence to applicable policies and regulations and providing writing support where needed.
Assist OIE compliance investigators with identifying and implementing opportunities to use informal resolution and alternative dispute resolution to resolve reports and complaints.
Perform informal resolution practices to address complaints and allegations and coordinate with the Education Team to offer restorative resolution strategies.
Advise university leaders and officials regarding the investigation process.
Support the production of the OIE Annual Report in collaboration with the Program Director, Communications/CECAC and the Senior Compliance Analyst.
Coordinate the investigation of student harassment, discrimination and sexual misconduct complaints and work with the AVP, Office of the Dean of Students and the Office of University Counsel to prepare cases for hearing.
Develop, review, and revise content for the university's written and online materials related to all matters in coordination with the Program Director for Communications in OIE.
Develop and deliver presentations regarding OIE processes, procedures and other relevant matters to stakeholders and constituents
In collaboration with members of the university community, develop and enhance training, education, and awareness programs pertinent to all relevant policies.
Investigate and/or manage investigations regarding complex legal issues and/or administrative complexities as needed.
Required Qualifications at this Level
Education/Training
JD or other pertinent graduate degree required.
Experience
Minimum of 7 years of experience investigating, litigating, or otherwise resolving discrimination complaints (including Title IX complaints) in a college/university or governmental setting.
Working knowledge of Title IX, litigation and/or investigation experience, experience working with universities or on a university campus, and demonstrated ability to work across and lead a diverse group of constituencies preferred.
Knowledge of Title VI, Title VII and other civil rights laws, regulations, litigation, investigative practices in a higher education setting.
