Occupational Summary

The Senior Equal Opportunity/Compliance Investigator and Policy Analyst provides support to the University in creating a safe and respectful educational and employment environment by managing and addressing instances of discrimination, harassment and sexual misconduct through investigation, informal problem-solving and shared management of compliance staff. The Senior Investigator will be expected to work independently, but report to the Assistant Vice President for Harassment Prevention and Complaint Handling/Title IX Coordinator. The Senior Investigators' primary responsibility will be to participate in oversight of the University's compliance with laws, rules, and University policies and procedures on discrimination and harassment within the employment area.

Work Performed

Conduct independent, thorough and impartial faculty and non-faculty staff investigations of reports of violations of Duke's (Policy against Prohibited Discrimination, Harassment and Related Misconduct, and the Student Sexual Misconduct Policy) through development of an investigative plan to include interviews of complainants, respondents, witnesses, and others, and identification and collection of other available and relevant data. Conduct research on questions relevant to the analysis required in the course of investigations. Prepare comprehensive written reports related to investigations.

Review and edit policies and procedures related to discrimination and harassment to ensure compliance with the law and alignment with best practices, including the monitoring of developments in law, policy, and practice related to employment discrimination and harassment, Title IX, and sexual misconduct. Advise on the need for additional policies and prepare drafts of relevant policies. Support and consult with appropriate University administrators, managers or supervisors in furtherance of ensuring compliance with laws, rules, and University policies and procedures on discrimination and harassment in education and employment.

Provide oversight to OIE compliance investigators with their case management, including applying the applicable policy and or regulation, reviewing and editing relevant documents, supporting adherence to applicable policies and regulations and assist in preparation of investigation reports where appropriate and needed.

Perform informal resolution practices to address complaints, concerns or allegations.

Conduct periodic travel to off-site university programs to respond to reports.

Review investigation and reports with identified University staff and respond as necessary to complete investigation.

Provide testimony to, and answer questions from, hearing panelists about investigation.

Assist in maintaining database related to reports of discrimination and harassment and develop reports, assess trends, and identify areas of concern in the campus environment and beyond. Support preparation of Annual Report.

Complete other projects as assigned.

Required Qualifications at this Level

Education/Training

Work requires a Bachelor's degree in a related field.

Experience

Requires seven years of experience investigating and resolving discrimination complaints, including complaints alleging sexual violence or sexual misconduct.
