Occupational Summary
The Paralegal - Clinical Risk Management is a full-time position for an experienced paralegal with broad general knowledge in the legal and healthcare risk management fields. This position will provide paralegal support and report to the Associate General Counsel (Risk Management/Claims/Litigation) in the Office of General Counsel who represents Duke University ("DU"), Duke University Health System ("DUHS"), Duke Health Integrated Practice ("DHIP"), and their providers (insured by captive insurance company Durham Casualty Company ("DCC")).
This paralegal position will assist the Associate General Counsel (Risk Management/Claims/Litigation) in the assessment, management and defense of professional medical liability investigations, claims, and litigation, and perform other tasks as assigned by the Associate General Counsel (Risk Management/Claims/Litigation). Experience in risk management and/or professional medical liability claims and litigation management as required.
Work Performed
Monitor and track individual cases and progress, maintain internal status updates relating to cases, accurately identify and input data into electronic filing systems, collect documentation to meet deadlines, open and close electronic and hard copy files, and compose, edit, and send formal correspondence as appropriate.
Serve as liaison between the Office of General Counsel, the DUHS Clinical Risk Management Department DU, DUHS, DHIP, healthcare providers, senior leaders, and external counsel.
Prepare internal case-related financial and operational reports and analyses utilizing data from appropriate sources to summarize findings and to reflect case progress, adverse trends and appropriate recommendations and conclusions.
Review and summarize medical records.
Complete and summarize medical literature research.
Assist counsel with internal investigations.
Assist counsel with coordination of discovery responses and production of discovery materials.
Request, review, and coordinate the production of medical records, risk management files, Epic and Secure chat communications, and other relevant materials to external counsel.
Draft, prepare, and facilitate executive approval of DCC reserve requests and LAFs.
Prepare comprehensive file summaries and manage introductions of healthcare providers to external counsel.
Draft, prepare, and manage the timely issuance of preservation notices in connection with anticipated litigation.
Coordinate with DUHS Patient Resource Management Organization ("PRMO") on claim and litigation investigations related to billing information management.
Provide support to external counsel and healthcare providers with depositions, subpoenas, complaints, and requests from medical licensing boards.
Manage case closure and resolution activities including, but not limited to, notification of settlement documents, coordination of settlement payment requests and delivery, necessary reporting requirements, and digital and/or hard copy file close out.
Assist with preparation and notification of case updates to executive leadership for quarterly Joint Liability Steering Committee ("JLSC") meetings.
Provide support for annual reinsurance processes including, but not limited to, the annual case review of DCC investigations, claims, and litigation.
Coordinate with the DUHS Health Information Management department ("HIM") to facilitate the timely fulfillment of subpoenas, court orders, patient authorizations, and licensing board requests for medical records and additional information.
Draft, prepare, and coordinate credentialing and renewal documentation for healthcare providers and the DUHS Credentialing departments.
Provide support for annual KPMG audit of claims and litigation.
Coordinate with the DUHS Graduate Medical Education ("GME") department to provide legal administrative support to medical trainees and compile annual report of medical trainees who are departing from Duke at the end of each fiscal year.
Conduct research, develop content, and create detailed and effective presentation materials.
Independently prepare complex documentation, reports, charts, graphs, and spreadsheets at designated intervals and as requested.
Responsible for key aspects of file handling, such as engagement letters, preservation notices, and assistance with certain investigation and discovery activities as assigned.
Coordinate and complete special projects as assigned.
Perform other related duties incidental to the work described herein.
Required Qualifications at this Level
Education/Training
Work requires Bachelor's degree in related area and/or equivalent combination of relevant education and professional experience. Requires broad general knowledge in the legal and/or medical field.
Experience
Work requires twelve (12) years experience in risk management and/or professional medical liability claims and litigation management.
